General terms and conditions
Terms and conditions of Performance-Cars AG.
Minimum age
From age 21. Exception: 18–21-year-olds only when accompanied by a parent.
Rental agreement
A rental agreement for a vehicle is only concluded in writing. The renter confirms that they hold a category B driving licence. The agreement is entered into via the contact form, by e-mail or by signing a written contract.
Verbal agreements are possible as well, but only become contractually valid once confirmed in writing.
Bookings
A booking is valid once the date has been confirmed in writing and the outstanding amount has been paid.
Payment options are: e-banking / payment slip, cash on site, card payment.
Payment
Payment is made before the rental. The payment period is normally 5 working days.
Cancellations
If the renter is unable to keep the agreed date, we ask to be told as soon as possible. Cancellations must be announced at least 48 h before the booked date. The cancellation fee is 30 % of the rental amount. If the renter fails to appear on the agreed date without notice, the deposit paid is forfeited and is credited against the lessor's claims.
Rescheduling announced at least 48 h before the rental starts is free of charge.
Deposit & excess
No deposit.
Excess for all Performance-Cars AG vehicles: CHF 3000.–
Refuelling
The vehicle is handed over with a full tank and must be returned with a full tank.
Right of withdrawal
Under certain circumstances Performance-Cars AG reserves the right to withdraw from the rental agreement or to reschedule it. Such circumstances include bad weather (increased risk of accident), heavy traffic (increased risk of accident) or other disruptive circumstances that put the vehicle at risk, as well as the vehicle being unavailable (e.g. after damage to it). In these cases neither side incurs any further costs.
Collection / handover
The vehicle is always handed over and returned at the Performance-Cars AG site unless agreed otherwise with the lessor. Free parking is always available for our customers. For rentals of 48 h or more the vehicle can be delivered to a place agreed with the renter. This service is available for a surcharge and must be arranged in advance with a member of the Performance-Cars AG team.
Third parties
The rented vehicle may only be driven by the person who signed the rental agreement. Third parties may only drive a rental vehicle if this has been agreed with the lessor in advance and the third-party driver's details have also been recorded.
Use
The vehicle is inspected for defects before and after the rental. Any defects must be reported and recorded in writing before and after the rental. To preserve the value of the vehicle, smoking, eating and drinking in it are strictly prohibited. Parking in tight spaces and in underground or multi-storey car parks is also not permitted. The vehicle must be driven in accordance with road traffic regulations. The renter is held responsible for improper handling of the vehicle.
Wear parts such as brakes, tyres, the clutch and so on can also be damaged by improper handling of the vehicle. The renter is liable for such damage and may subsequently be held to account by the lessor. Improper braking overheats the brakes, which are then damaged if driving continues (e.g. warped brake discs).
Damage to the vehicle caused by over-revving the engine, missed gear changes, overheating the clutch by slipping it for too long, standing starts, excessive tyre wear or any kind of misuse means full liability on the part of the renter. Such damage can nowadays be proven by the on-board computer / data box. Performance-Cars AG reserves the right to carry out a subsequent analysis if misuse is suspected.
Passengers
The renter must themselves inform any passengers about the risks that riding in the rented vehicle may involve. The lessor bears no responsibility for passengers in connection with the use of the vehicle by the renter or an authorised driver.
Use of the vehicle
The vehicle may only be used on public roads in accordance with road traffic regulations. It may not be used off paved roads or off-road, on race tracks, for driving lessons or driving practice, or for motorsport purposes – in particular events in which the aim is to reach a top speed. The consequence of doing so: loss of insurance cover.
Trips abroad must be discussed with the lessor in advance.
Accidents and damage resulting from gross negligence, from the misuse of drugs or alcohol, from excessive or inappropriate speed, from adverse weather (rain, snow, ice and so on), or damage caused by tailgating, vandalism or unknown third parties mean full liability on the part of the renter. The renter must pay the full cost of the damage immediately.
Accidents and damage
After an accident, fire, theft or collision with an animal, the renter must notify the police and the lessor immediately. In the event of any damage the renter must: take all measures needed to establish and document the facts; call the police immediately and remain at the scene until the police have recorded the accident (if the police refuse to record it, the renter must prove this to the lessor); note the names and addresses of everyone involved, the registration numbers of the vehicles involved and the insurers of those involved, as well as the names and addresses of all witnesses; send the lessor a carefully and fully completed accident report; notify the lessor of an accident by telephone immediately and pass on the information recorded.
In an accident involving a serious speeding offence, the fully comprehensive insurance covers no consequential costs. In such a case the renter must settle those costs immediately.
The renter is not entitled to admit liability verbally or in writing, or to pre-empt the settlement of the claim by the insurers of the rental vehicle through other statements, concessions or payments. When returning the rental vehicle the renter must report all damage, malfunctions and accident damage without being asked. This obligation applies even if the damage has been repaired in the meantime. Even where fully comprehensive insurance exists, the renter is liable for the consequential costs caused in cases of gross negligence or a serious speeding offence.
The renter must likewise inform the lessor immediately of any other faults with the vehicle.
Penalties / fines
Fines and penalties incurred during the rental period are payable solely by the renter.
