Principle

We process personal data in accordance with the Swiss Data Protection Act (revFADP) and, where applicable, the EU General Data Protection Regulation (GDPR). We only collect data that we actually need for the service requested.

Data you send us via the forms

This website has four forms: contact, enquiry, group enquiry and voucher order. Depending on the form, we process the following details:

Contact form: name, e-mail address, phone number, your message.

Enquiry form: in addition your preferred car, rate, delivery request and, where applicable, delivery address, preferred date, pick-up time, planned trips abroad, number of drivers and age (confirmation of the minimum age).

Group form: in addition the occasion, number of people, preferred date, duration, preferred cars and the programme elements you are interested in.

Voucher form: in addition the billing address (street, postcode, town, country), delivery method and optionally the name of the person receiving the voucher.

Purpose: handling your enquiry, preparing an offer, processing the rental or the voucher order.

Legal basis: steps prior to and performance of a contract (Art. 6(1)(b) GDPR) and our legitimate interest in answering enquiries (Art. 6(1)(f)).

Retention: enquiries that do not lead to a contract are deleted no later than twelve months after the last contact. If a rental agreement is concluded, the statutory retention periods apply (normally ten years for business records).

Transmission of the form data

The forms are received by a Cloudflare Worker and delivered as an e-mail to our business address. The processors involved are:

Cloudflare, Inc. – hosting of the website and operation of the form endpoint. Technical connection data (IP address, time, user agent) is processed in the course of this.

Cloudflare Turnstile – spam protection for the forms. Turnstile checks whether a submission comes from a human. IP address and technical browser characteristics are processed in the course of this. Turnstile sets no advertising cookies and builds no cross-site profiles.

Resend (e-mail delivery service, USA) – delivery of the form message to our mailbox and of the automatic confirmation of receipt to your e-mail address.

Data processing agreements are in place with all service providers. Processing outside Switzerland and the EEA is possible; it is based on standard contractual clauses or equivalent safeguards.

Server log files

When the website is accessed, technical data is logged automatically (IP address, date and time, page requested, referrer, browser and operating system identifier). This data serves solely the secure and stable operation of the site and the defence against attacks, and is deleted automatically after a short time. The legal basis is our legitimate interest in the secure operation of the website.

Cookies and tracking

This website sets no analytics, advertising or tracking cookies and embeds no social media widgets. No audience measurement takes place. Fonts and images are served from our own server; Google Fonts is not used.

Cloudflare Turnstile may set a technically necessary token to prevent abuse. It is not used to recognise you across different websites.

Map on the home and contact pages

The map image is a graphic stored on our own server. No map from Google, Apple or any other provider is embedded, and no data is transmitted to third parties when you view the page.

Clicking the map image or “Directions” opens the maps app or map page on your device – Apple Maps on iPhone and iPad, otherwise Google Maps. Only that click establishes the connection to the provider concerned; that provider alone is responsible for its data processing.

External links

We link to WhatsApp, Google Maps, Apple Maps, OpenStreetMap and to our profiles on Instagram and Facebook. These links only become active when you click them; only then do the providers concerned receive data from you. Those providers alone are responsible for their data processing.

Newsletter

You can sign up for our newsletter in the footer of the website. Sign-up, storage of your details and sending are handled by the newsletter service Brevo. We use the details from the form (email address, name and, where provided, phone number and date of birth) solely to stay in touch with you and to send you news and offers from Performance-Rent.

The legal basis is your consent (Art. 6(1)(a) GDPR). You can unsubscribe from the newsletter at any time via the unsubscribe link at the end of every email or by sending a message to info@performance-rent.ch.

Your rights

You have the right to information about the personal data we process, as well as to rectification, erasure, restriction of processing, release or portability of the data, and to object to the processing. You can withdraw consent you have given at any time with effect for the future.

An informal message to info@performance-rent.ch is enough to exercise these rights. You may also lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or with the supervisory authority responsible for you.

Data security

The website is delivered exclusively encrypted over HTTPS. We take appropriate technical and organisational measures to protect your data against loss and unauthorised access.

Changes

We update this privacy policy when our services or the providers we use change. The version published on this page at the time applies.
